The US does have a ban on car dealers, and if you are the owner of a car dealership, you can’t just go and buy another one from the internet.
The Federal Trade Commission has ruled that car dealers must be licensed in order to do business in the US, but there are exemptions that allow the government to set rules on how they operate.
The US government has a number of exemptions to the car dealers license requirement, so if you want to buy a used car or other car from a dealership in the States, you have to go through the same process as the rest of us.
This means that if you sell a car in the USA, you must obtain a dealer license.
Here are the exemptions:A: A dealership may purchase a used vehicle that is sold for $5,000 or less.
The manufacturer must be able to show that it is “generally accepted as safe and reliable for the purchaser to drive that vehicle in any traffic conditions and that the vehicle is properly maintained.”
B: A dealer may sell a used or used-for-sale vehicle that has been sold at a dealership that is located in another state and that is operated in compliance with state law.
C: A car dealer may not offer a service that requires the purchase of insurance or finance in addition to the sale of a vehicle.
D: A used car dealer must have a certified appraisal of the vehicle and the owner must submit an application for a dealer appraisal.
E: A vehicle may not be sold at any dealer in the United States for less than $10,000.
F: A seller of a used-car may not purchase any other vehicle in the same lot.
G: A manufacturer may not sell a vehicle that the manufacturer is aware is defective.
H: A motor vehicle dealer may only sell used vehicles that are “fully capable of carrying out the normal operations of the operation of the motor vehicle and that do not present a significant risk to the public safety.”
I: A commercial motor vehicle dealership may not resell any vehicle that it has sold or leased.
J: A person may not own a vehicle without the consent of the owner.
K: A use-of-vehicle dealer may provide services to a consumer to whom the dealer is selling a vehicle or service if the person has not acquired the vehicle for the purpose of purchasing the services.
L: A repair facility may not accept or lease a vehicle, but may sell or lease used vehicles to the customer for use by the customer.
M: A retailer may not rent or lease more than 50 percent of the total amount of a lease, but a retailer may lease up to 50 percent or more of the lease.
N: A leasing company may not lease more of a leased vehicle than is authorized by the lease agreement.
O: A lessee may not obtain a vehicle under a lease arrangement unless the lessee has paid all applicable taxes and insurance costs and is able to demonstrate that the leased vehicle is being maintained in a safe, adequate, and convenient condition.
P: A company may only use a dealer that meets certain requirements.
Q: A non-commercial motor vehicle retailer may only lease a car or used vehicle to a customer for up to 60 days, and may only make payments on a lease for a car.
R: A limited liability company may lease a used motor vehicle or motor vehicle for up the term of the original lease agreement, but must provide an inventory of all vehicles leased.
S: A leased vehicle may be returned to the owner at any time and the lease may be renewed for an additional period.
T: A salesperson may not charge a fee for the sale or rental of a certain vehicle.
U: A private label retailer may charge a $5 per vehicle fee.
V: A transportation provider may not require a transportation provider to sell a leased motor vehicle to customers who do not have the vehicle.
W: A consumer may not buy or rent a vehicle for more than 30 days in any calendar month without the owner’s consent.
Y: A carrier may not provide services that provide or cause the delivery of a person or vehicle to be unsafe or defective.
